Bartosz Grabowski, an Illinois resident, has filed a 6-count class-action lawsuit against Apple in Cook County, Illinois, over its Powerbeats Pro wireless earphones.
The lawsuit filed with the court generally states that the earbuds are made with faulty materials and won’t charge properly, rendering them unusable.
In his complaint, Plaintiff stated unequivocally that “Defendant’s charging case fails to consistently and adequately charge the Powerbeats Pro headphones despite Defendant’s advertisements and assurances regarding the Powerbeats headphones‘ listening time due to a design defect and/or Defendant’s use of substandard materials.
The headphones cannot maintain a suitable connection with the charging case due to this flaw and are consequently unfit for their intended use.
Recall that last month, January, Alejandro Vivar, a New York citizen, filed a prospective class-action lawsuit alleging that design flaws in the Powerbeats Pro wireless earbuds prohibit them from charging properly.
Vivar claimed in federal court in New York that he purchased the headphones believing they would last longer owing to package promises.
“Unfortunately, a significant percentage of users experience battery draining and charging issues with the Product which limits its functionality and usage,” Vivar says.
The earbuds are sold under the Beats brand, which is now owned by Apple and was previously known as Beats by Dre.
Battery life is one of the most essential qualities of wireless earbuds. Still, the device is draining battery and also has charging issues, as experienced by both users, which trigger the filing of the lawsuit.
It should not be forgotten that the American tech giant agreed to pay $9.75 million in 2020 to settle accusations that the Powerbeats2 battery life is inadequate, lowering the value of the wireless earphones.
